Bloggers without a realtor certificate and a contract with the property owner will lose the right to advertise real estate in Kyrgyzstan once a new law is adopted. Deputy Minister of Economy and Commerce Benazir Nurlanova announced these provisions on October 7 at a meeting of the Jogorku Kenesh during discussion of the draft law "On Introducing Amendments to Certain Legislative Acts of the Kyrgyz Republic (into the Code on Offenses and the Law 'On Realtor Activity in the Kyrgyz Republic')", Tazabek reports.

What will change for the market?

According to Nurlanova, realtors will be required to undergo state registration and training. New requirements for advertising:

  • mandatory indication of the realtor's certificate number;
  • mandatory indication of the contract number with the property owner;
  • verification of the realtor's status through a special registry.

Property owners will retain the right to advertise their own real estate independently — without a certificate. The restrictions will apply to intermediaries and bloggers promoting other people's properties.

How much will the fines be?

For realtor activity without registration, the draft law provides for fines:

  • 10 calculation indices (1 thousand soms) — for individuals;
  • 50 calculation indices (5 thousand soms) — for legal entities.

Nurlanova emphasized that the sanctions are set at a minimum: for comparison, entrepreneurs are fined 5 thousand soms for working without tax registration.

A warning or an immediate fine?

Deputies Nilufar Alimzhanova and Altynbek Kylchbayev proposed limiting the response to a warning for a first offense — many market participants may be unaware of the new requirements.

"We are used to — fine, fine, fine, we have learned only to take money from people. Humanity must also be taken into account," Kylchbayev said.

Nurlanova objected: "I somewhat disagree with your words that we have learned only to take money. People will start interpreting this as being for the purpose of collecting money."

She added that there are very many violators in the market, and regulating this wave through warnings and repeat inspections would be difficult. Therefore, in her view, it would be more effective to impose fines immediately. At the same time, the deputy minister expressed readiness to consider the deputies' proposal by the second reading of the draft law.

Significance for the advertising market

For influencer marketing in the real estate segment, Kyrgyzstan is introducing the first clear qualification barrier: advertising properties will become available only to verified realtors with a certificate number in the registry. Bloggers and agencies working with developers and property owners will either have to undergo registration or abandon this form of income.
